I received a phone call from a potential client with real estate in three states, a 10 -year -old son, two older children that they want to put in charge, and many millions in assets. They have been putting off their estate planning for years, is that smart?  I will let you decide. 

HOW CAN THE COUPLE ABOVE BE PROTECTED WITH ESTATE PLANNING?

This married couple with real estate investments, businesses, bank accounts, a Miami Beach home and three children, one only ten years of age, need estate planning. They need wills, revocable trusts, health care documents, power of attorneys, and funding assistance for their trust. The trusts can include restrictions as to how much and when the kids will be able to have full access to the funds.  I also advise that they write letters to their kids, a nice addition to any estate plan. 

WHAT IS THE BENEFIT OF DELAYING? WHAT IS PROBATE?

There is no benefit to delaying your planning. By delaying, you are taking a huge risk and your loved ones will likely need to go to probate court to collect and distribute your assets. Probate court in Miami-Dade and Broward County is expensive, tedious, and filled with delays. 

Another recent call was from the son of a 91-year-old man. His Dad was not able to do his estate plan as he died in a car accident and now needs to hire a probate attorney for his complicated estate. It is better to be prepared and give yourself peace of mind, rather than delay and worry about it. Or sadly, not prepare and cause your children worry and hardship in probate court.
