ESTATE PLANNING IN MIAMI BEACH, FLORIDA, PROBATE NIGHTMARE PART 4

In a past Blog, I wrote about a sweet married couple on their second marriage with separate assets. The husband had no children and left everything to his wife. We discussed the sad story of two probates and the delays in New York and Miami.

PROBATE COURT IN NEW YORK AND MIAMI? ANY UPDATES?

I am happy to report that my client, the wife, has finally received all of her money. The last check from New York was finally received this week. She is so grateful and so am I.

WHAT COULD HAVE BEEN DONE TO PREVENT THESE DELAYS?

This entire case and both New York and Miami probates could have been prevented with proper estate planning. I am passionate about this topic as the delays are unnecessary. Estate planning gives the creator peace of mind while benefitting the loved ones left behind.

In this case, if a revocable trust was created and funded with the husband’s bank and investment accounts during his life, whether in New York or Miami or both, the wife would have access to all of it through his trust upon his death.

WHAT IS MISUNDERSTOOD ABOUT WILLS? ARE WILLS ENOUGH?

Wills do not protect you or your loved ones. Wills do not prevent probate court involvement. When a person dies with a will and assets, a probate case is required to collect and distribute those assets. Revocable trusts protect you during life and protect your loved ones upon your death. With a properly funded trust, instead of waiting over a year to get your assets, assets can be transferred quickly and easily.
