PROBATE MATTERS-WHAT DOES THIS MEAN?
Many people that come to me for estate planning ask why they should plan now instead of leaving their assets in probate later. The answer is simple-probate matters to the loved ones left behind. If you plan ahead, you save your loved one time, money, and unnecessary delays.
This week I received a call from a daughter who is finally ready to probate her mother’s estate after ten years. They are finally ready to sell her house and it is in the name of her brother and their deceased mother.
HOW COULD THIS PROBATE IN MIAMI_DADE COUNTY HAVE BEEN AVOIDED?
This probate could have been avoided so easily. They merely had to add six words to the deed; “joint tenants with rights of survivorship.” Because all of the accounts were titled with paid on death beneficiaries, the accounts went directly to the loved ones and avoided probate. Again, the property is in the name of the brother and his wife, and the deceased mother. In this case, brother and sister are very close and get along great, but what if they did not?

After the sister and brother agreed to hire me and move forward with the probate, I began to create the documents for the probate court to review. I filed all of the death certificates for their mother, her late husband, and sadly their third sibling. I filed the will, the deed, and the tax bill showing the lawful owners. I filed the required documents by the court, for which there are many. Both Dade and Broward probate courts even have court mandated checklists that are required to be filed for each type of case. And now, we wait. The court will process the documents and once accepted we will receive a case number. With the case number, I can file more documents and the related Orders for the Judge to sign. And again, then, we wait.
