A long-time friend passed away from a sudden heart attack. He was a 49-year-old husband and father of two young boys. He looked healthy and fit and exercised often. He had a relaxed happy demeanor and he never did any planning. He left many friends and loved ones behind and he will be missed.

Yes, his wife does have to hire a probate attorney in Miami-Dade County, FL and go through probate administration to move the assets from his name to her name. Being married and having children together does not automatically allow the surviving spouse to transfer assets into their name. If a married couple owns everything in joint name, the assets can transfer without probate; but, in this case, where assets are owned separately, probate administration is required and a Judge will decide how and when the assets are transferred. His wife must prove that they are legally married and list all of the assets to be transferred in the estate inventory. 

WHAT ARE REVOCABLE TRUSTS ? HOW CAN PROBATE BE PREVENTED?

In the example above, to prevent probate court involvement, a revocable trust could have been created and all of the real estate and assets placed into the trust.
