DO YOUR ESTATE PLANNING NOW- TIME IS TICKING

I am still working on my probate case where the Mom passed over ten years ago; it is real work. The probate courts both in Miami-Dade and Broward County change the rules often. The newest procedural change requires checklists in both Broward County and in Miami-Dade County to be filed with any proposed order. I filed all of the pertaining documents, received acceptance notification from the court, and am now waiting on the Orders to be signed by the Judge.

WHY WOULD ANYONE PREFER PROBATE COURT OVER ESTATE PLANNING?

No one prefers probate court over estate planning, no one, especially not your loved ones. I get asked questions daily from loved ones asking about selling the house, staying in the house they have lived in for years, and paying the bills for the house. All of these details can be worked out inside a trust and it is a quick, private process.

WHAT HAPPENS IF I WAIT TO DO ESTATE PLANNING IN MIAMI BEACH, FL?

If you wait to do estate planning, you may be okay. A single mother called me over five years ago and then finally completed her estate plan recently as she felt it was important after having witnessed all the deaths from COVID-19.  Another successful single female called me years after our first chat to get started on her estate planning. She owns a few rental condos and her homestead, and has substantial investments that she would like to go to various family members upon her death. We are creating a trust and then putting her assets inside the trust, thus protecting her and her loved ones. A properly funded trust protects probate, guardianship, and keeps things simple.

WE ALL HAVE WISHES- WHY NOT DO A PROPER WILL AND TRUST?

A will and a trust are the basic foundation for a good estate plan. By doing these two documents, along with health care documents and a power of attorney, you are protecting yourself and your loved ones. Estate planning can keep matters private, avoid probate and guardianship court involvement, and simplify your wishes.
