HOW DO I FIND A GOOD PROBATE ATTORNEY IN MIAMI BEACH, FL?

Probate is the court process that is required when someone dies with assets in their own name without a paid-on-death beneficiary. Probate assets are often real estate, but can be investments, bank accounts, and even retirement assets if there is no named beneficiary. Probate is a specialized area of the law with many rules and specific ways of doing things in both Miami-Dade and Broward County, FL. A good probate attorney will know all the probate rules and procedures and be very familiar with the clerks, Judges, and probate attorneys. We even have our own list serve for probate attorneys where a group of us that all practice in Dade and Broward ask questions among the group.

WHY DO I NEED TO HIRE A PROBATE LAWYER?

There are many required documents and rules for probate court. Most probate procedures require the hiring of a probate attorney to move forward. A probate attorney will make sure you are protected and that your case is moving forward, file documents on your behalf, and lead you in the right direction.

HOW DOES PROBATE WORK AND HOW LONG DOES IT TAKE?

The length of time of a probate case varies depending on the complexities and details regarding the case. If it is a contested matter (a fighting case), which I do not handle, they take much longer and last a year or many years depending upon the facts of the case. I only take on peaceful probate matters which usually take 6-12 months on average or less if they are very simple or if the person passed away over two years ago.

ARE THERE ANY PROBATE CASES THAT TAKE 3-6 MONTHS OR LESS?

Yes, a probate case that involves a decedent who has been dead for over 2 years moves much faster in the probate administration in both Miami and Broward. This is because there is no longer required the notice to creditors and many of these creditor issues are not relevant after the two years have passed. There are some specific creditors that outlast the two years, for example, certain IRS matters would remain regardless of the amount of time that has passed.
