In a past Blog, I wrote about a sweet married couple on their second marriage with separate assets. The husband had no children and left everything to his wife. This nightmare still continues a year and a half later. The probate in Miami, Florida continues as we wait for the New York assets to be collected. There were two bank accounts in New York that required the New York probate court involvement, one that she has now received the money and one that remains uncollected because of delays.
PROBATE COURT IN NEW YORK AND MIAMI?
Probate court in New York had a six month back log. Finally, the probate in New York was opened, orders were issued, and sent to the two banks holding the late husband’s money. Sadly, the last bank now has a 7-10 week wait. Thus, the sweet elderly wife, received one banks distribution and has to wait even longer to get her money from the second bank.
HOW COULD THIS PROBATE NIGHTMARE HAVE BE PREVENTED?
Both probates in Miami and New York could have been prevented with a properly funded revocable trust. If created and funded, all accounts and real estate would be owned by the revocable trust and easily distributed as stated in the trust upon his death.
