On August 28th, 2020, Chadwick Boseman, the star of the blockbuster superhero movie “Black Panther” died of colon cancer. He was a 43 year-old husband, movie star, and friend to many- he will be missed. He looked young, healthy, fit, and heroic and continued to keep his illness private and work on his movies even while receiving treatments. Chadwick did such a great job on “Black Panther” and it was nominated for 6 academy awards, including best picture.
WHAT HAPPENS NOW? DOES CHADWICK’S WIFE HAVE TO GO THROUGH PROBATE COURT TO TRANSFER HER HUSBAND’S ASSETS INTO HER NAME?
Yes, if there are any assets in Chadwick’s name alone, his wife must go through probate administration to move the assets from his name to her name. Being married does not automatically allow the surviving spouse to transfer assets into their name. The surviving spouse must present the will, if one exists, to the probate court. Once authenticated, the will can then be used as a map for the probate Judge to follow and distribute the assets accordingly. If no will exists, the intestacy statue prevails.
WHICH STATE PROBATE COURT PRESIDES?
The state in which the person lives and dies is where the main probate occurs. Other probate cases, called ancillary probates are required to collect and distribute probate property in other states or countries. For example, I once had a probate case where the wife died at 93 and she left millions of dollars, 50% to her husband and 50% to her nieces and nephews. She had property in Miami Beach, Fl and England; thus the main probate, the formal administration was handled here by me and the ancillary probate was done in England for the real estate left in her name alone upon her death.
