I received a call from a married couple wanting to do estate planning to protect their children. The husband was very concerned with the previously signed prenuptial agreement and how it would affect his family in the case of his death. He has one wife and they have children together. 

WHAT IS A PRENUPTIAL AGREEMENT?

A prenuptial agreement is an agreement signed in anticipation of marriage. For example, Avery is getting married and has five million dollars in assets, real estate, and investments and wants to keep it all. Avery then hires an attorney who represents Avery’s interests and creates documents for Avery’s future spouse to sign agreeing to the terms in the case of divorce. Avery’s spouse needs to have her own attorney and be aware of the financials involved.

Estate planning and prenups are completely different documents. Prenups apply in the case of divorce, yet may also mention death benefits, or waiver of death benefits. Estate planning is done to protect you and your assets in the case of incapacity or death.  Getting back to our example above, the young married couple with small children can do an estate plan giving everything to the wife and kids upon the death of the husband, and if they ever got divorced, the prenup would still shield his assets, if properly done. Or in the alternative, all assets can go to the kids upon the husband’s death and the wife can receive a monthly allowance during her life.
