THE CORONAVIRUS AND ESTATE PLANNING IN MIAMI BEACH, FL- PART III

The Coronavirus pandemic is awakening us all that life is delicate and can end at any time. This is helpful to me as a Miami Beach Estate Planning Attorney as it creates a sudden urgency to begin and complete estate planning documents. My most recent calls have been from all types of people who recognize this urgency and want to get their documents done.

WHO IS DOING ESTATE PLANNING NOW?

A married couple who moved here from California and needed to redo their wills and trusts to make them current and in compliance with Florida law and Florida residency recently contacted me to get their planning done. A single woman with no kids and some special relatives wanted to make sure those relatives received her assets when she died. A single mother with two small children and health issues called to get started on her estate planning. Finally, a married couple with separate kids and second marriages called to get their documents in order.

WHAT IS THE RUSH? CAN I WAIT FOREVER TO DO ESTATE PLANNING?

Waiting is not the best option and can lead to many problems for the relatives left behind. I received a call last week from a young wife and mother, who was calling for me to handle a new probate matter for her husband. He had a sudden heart attack and died instantly, leaving behind his wife and child. He left numerous business, bank accounts, and investments, and real estate all in his name alone.  His wife was heartbroken not only because of his death but also because she had begged him to do estate planning for many years. He was in his early fifties and felt young and invincible. Now his wife and child have to deal with complicated court matters and hiring a probate attorney, when this all could have been taken care of while he was still alive.
