HOW CAN I PREVENT THE NEED FOR PROBATE COURT IN MIAMI, FLORIDA?

I receive many calls where probate is required in Miami, Florida. The surviving loved ones call me to hire a Miami probate attorney and get the case started. Most of these probate cases could have easily been prevented by good estate planning. Estate planning in Miami Beach, Florida saves the family time, money, and simplifies the process when dealing with a death or incapacity.

WHAT ARE THE MOST EASILY PREVENTED PROBATE CASES IN MIAMI BEACH, FL?

The most easily prevented probate cases are those involving bank accounts. While living and competent, a person can name a POD beneficiary. This is a person who can show a death certificate and collect the monies without court involvement upon the decedent’s death. When doing this, I recommend naming an alternate beneficiary in case both the decedent owner and the first beneficiary are both deceased. The challenges with POD’s are they often oversimplify your estate and leave you and your loved ones vulnerable. If you are leaving POD’s to minors, guardianship court is often required. Thus, even with a small to mid-size estate, estate planning is often the best option.

HOW CAN I PREVENT MY REAL ESTATE IN MIAMI BEACH, FL, FROM ENDING UP IN PROBATE COURT?

The best way to avoid probate court with real estate is to place the real estate in a trust. Sometimes, people take a short cut and choose to do a lady bird deed, which gives a life estate to the owner. There are numerous problems with these deeds and should be used with caution. I have seen many examples where probate court is still required even when these deeds exist. Real estate is most protected from incapacity and death when transferred into trusts.
