Here is a conundrum. We have shared children, we trust each other, and we want to leave all of our money to our children. Is each other the best option for the trustee? Should we do our estate planning together? In some case yes and in some cases no.

Estate planning can be done with your x-spouse if the details are the same for each other. For example, let’s discuss Jim and Jenny, which are made up names for example purposes only. Jim and Jenny were married and divorced and remain business partners. They buy and sell real estate and continue to trust each other and have a great friendship. They did mirror estate planning, giving their kids everything and giving each other the power to manage, and live off of the properties during life.

Estate planning would be better separated if Jim and Jenny, our fictitious couple, remarried and had more children with their new spouses. The new children would require different planning. In addition, the new spouses and children would need to be acknowledged and respected, thus the x-spouse would not be making critical decisions.
