ESTATE PLANNING IN MIAMI BEACH, FLORIDA, IS ESTATE PLANNING ONLY FOR THE ELDERLY?

Estate planning is not just for old people. A young couple called last week when the husband of 42 years old was diagnosed with cancer. They want to do estate planning to protect the family and their children. An older woman called who is going through chemotherapy treatments and wants to get her assets and wishes in order. Estate planning is not just for sick people, estate planning is for everyone.

As an estate planning attorney in Miami Beach for over twenty-six years I have seen it all. I have single people with separate assets, married people with separate assets, and many people married or single with joint assets. The most common is a combination of it all and those are the best clients for me. These people can benefit the most from a great estate plan.

WHEN SHOULD I DO ESTATE PLANNING? ARE YOU READY?

Estate planning is for everyone. Death and taxes are the only guarantees in life so you might as well plan properly for both. Estate planning is a process. Clients come to me when they are ready. They know who they want in charge and how they want to leave their assets. I discuss each client’s goals, loved ones, wishes, and the law and create a unique estate plan for each client.

HOW CAN A MIAMI -DADE PROBATE CASE BE PREVENTED?

I am the probate attorney in a Miami-Dade probate case where there was a bank account with no listed beneficiary. Bank accounts are the easiest way to prevent probate. A person simply tells the institution and completes their required form naming someone as the POD (paid-on-death) beneficiary. When doing this, please list alternates, so if they die, you have more options. Another way to avoid probate court involvement in Miami-Dade County is to own real estate as joint tenants. This deed must be done correctly to avoid probate court.

The best way to avoid probate court is to place your investments, businesses, bank accounts, and real estate into a trust.   You can avoid probate by taking all the assets owned in your name alone with no paid on death beneficiary and funding your trust, or moving all assets into your trust during your life, protecting both your assets and your loved ones.
