ESTATE PLANNING IN MIAMI BEACH, FLORIDA, HOW DO I UPDATE MY ESTATE PLANNING DOCUMENTS?

I received a client email stating a few changes in her estate plan. For example, she wished to change the successor trustee, health care surrogate, and the successor guardian for her young children. She thought she could do this by letting me know. She is not alone, many clients send me emails just like this.

IS SENDING ME AN EMAIL WITH YOUR WISHES LEGALLY BINDING?

As I have explained many times in my over twenty-seven years of practice as a Miami Beach estate planning attorney, you cannot make oral changes to your documents. Changes must be written and signed with the same legal requirements as the initial documents. The best way to do this is to begin by making an appointment to review your current documents and the changes you wish to make.

WHAT HAPPENS AT THE ESTATE PLANNING REVIEW MEETING?

Similar to our first meeting, this review meeting will be used to familiarize myself with your wishes at the current time. For example, in the example above, my client was contacting me after seven years had passed. A lot can happen in seven years and a review is a great way to get reconnected with your assets, wishes, and documents.

HOW CAN I FURTHER BENEFIT FROM AN ESTATE PLANNING REVIEW?

Laws change, times change, and your wishes change through time. Doing a review can deepen your understanding of your trust and how to fund it. I have watched proudly as my clients understand a new layer of their planning with each update. Call me to update your wills and trusts.
