ESTATE PLANNING IN MIAMI BEACH, FLORIDA, HOW DO I GET MIAMI-DADE COUNTY HOMESTEAD EXEMPTION? THE HOMESTEAD PERIOD IS EACH YEAR FROM JAN-MARCH.

January 1st of each year begins the homestead application acceptance time period in Miami-Dade County. A person can apply for homestead if they own a home or apartment in Miami-Dade County and can complete the online application at www.miamidade.gov/pa .The person must be living in the home on January 1 of the year they wish for the exemption to apply. HOW DO I CLAIM AND PROVE MIAMI-DADE HOMESTEAD? WHY WAS I REJECTED?

Florida homestead is claimed by applying to the homestead office. Please check the website above for all pertinent information. If rejected, it could be because your driver’s license and voter’s registration are not registered in Miami Dade County. The office does a search for this automatically upon receiving the request for homestead.  

I RECENTLY DID MY MIAMI BEACH ESTATE PLANNING DOCUMENTS, CREATED A REVOCABLE TRUST AND MY MIAMI BEACH ESTATE PLANNING ATTORNEY ADDED MY HOMESTEAD TO MY TRUST BY DEED, WILL THE HOMESTEAD OFFICE ACCEPT THE TRANSFER AUTOMATICALLY?

The Miami-Dade County homestead office will not accept the transfer automatically. Without a deed transfer, they will send the homestead paperwork to your address confirming that it remains and asking you to respond by reporting any changes that may disqualify you. For example, you no longer live at that address. In the case of moving your homestead into your trust, you must be the trustee of your trust during your lifetime and have the special required homestead language in both your new transfer deed and the trust itself. The same is true for the 10% non-homestead cap, you must send a copy of the deed and your signed trust to the property appraisal office by email, mail, or by going to them in person and explaining your request to maintain your exemptions.
