ESTATE PLANNING IN MIAMI BEACH, FL- MY MOTHER IS DIAGNOSED WITH ALZHEIMER’S, WHAT DO WE DO NOW?
I received this call a while ago and am happy to report, all is well with the client and her family. Her estate planning is completely signed, the trust is funded, and her wishes fully documented. What a relief for her three adult children!
WHAT IF THERE IS NO PLAN?
In the above example, if there was no plan and the mother got forgetful or worse, a guardianship would need to be created to manage her assets and health care within the court system. A guardianship is a costly process with required annual accountings, paperwork, and checks and balances. The court appointed Judge would decide on every aspect of her care, financially and physically. Instead, she will avoid the courts and her family will manage her health care and finances according to her wishes.
DOES A DIAGNOSIS REQUIRE A SPECIAL SORT OF ESTATE PLAN?
This is another question that I receive often from clients. The answer is no; regardless of the diagnosis, the process is the same. We create a set of documents that match the client wishes, protecting their assets and their loved ones in the event of death or disability.
WHAT ARE THE PROTECTIVE DOCUMENTS USED IN ESTATE PLANNING?
Every person with assets and loved ones benefit greatly from an estate plan. The five basic documents everyone should have are as follows:
- TWO HEALTH CARE DOCUMENTS. These are two separate documents, HEALTH CARE SURROGATE AND HEALTH CARE DIRECTIVE, that explain who is in charge and what you want related to your health care. These documents are used only during life and only when you are unable to make health care decisions on your own.
- DURABLE POWER OF ATTORNEY. This document protects you financially. If you are ever unable to manage your financial matters, your nominated person can take over and protect you and your assets.
- LAST WILL AND TESTAMENT. This document only applies at death. It states your wishes and final preferences.
- REVOCABLE TRUST. In my opinion, this is the most important document ever created! Everyone should have trust if they have assets and loved ones. Trusts save people time and money and make both life and death easier to manage.
