DID YOU MOVE TO FLORIDA FROM ANOTHER STATE? DID YOU MOVE FROM CALFORNIA, NEW YORK, OR NEW JERSEY?

I received a call last week where a California resident left his 2 million-dollar home in California to a renter and bought a $500,000.00 condo apartment here on Miami Beach. He wanted an Estate Planning Miami Beach Attorney to assist him in the transfer of his Florida deed into his California trust. Is this a good idea?

DOES THE CALIFORNIA TRUST STILL WORK?

The California trust is not the best option for someone moving here and wanting to claim residency here. There is specific language required in a trust to get homestead approval and it is specific to Florida. In addition, each state has different laws and protections in place.

SHOULD I DO A NEW ESTATE PLAN IN MIAMI BEACH, FL IF I MOVE TO FLORIDA FROM ANOTHER STATE OR COUNTRY?

Yes, a new estate plan will maximize Florida laws and protections and is your best option. Florida is a great state to live in as we have no state income tax and die in as we have no state estate tax. A Miami Beach estate planning attorney like myself may create a new will, revocable trust, power of attorney, and health care documents specific to Florida law with the homestead language, residency language, and other protections.

DO WE SAVE MONEY ON STATE TAXES IF WE BECOME FLORIDA RESIDENTS AND FILE FOR THE HOMESTEAD EXEMPTION?

Yes, when you spend over six months in Florida, file your income taxes as Florida residents, and really move here this is a great plan! There are many other requirements as well. For example, your driver’s license and voter’s registration must both be registered in Florida.
