ESTATE PLANNING IN MIAMI BEACH, FL -RESISTANCE PART 2
I was called to write this on behalf of the children and loved ones left behind. A young single mother called with a ten-year-old daughter and asked if I could recommend an on-line inexpensive will document creation site. Online wills do exist. I do not recommend them as they are not personalized and do not solve most estate planning issues. The worst part to all of this is that these children left behind often end up in Miami-Dade,FL probate and guardianship court.
DO SINGLE PARENTS NEED TO HIRE AN ESTATE PLANNING ATTORNEY IN MIAMI BEACH, FL?
Yes, single parents with assets and young children need to hire an estate planning attorney in Miami Beach, FL. In many cases, the father is not listed on the birth certificate and even if he is, he may choose not to be involved. In the example above of the single mother with the 10 year old daughter and no father listed on the birth certificate, who would care for that child if the mother died suddenly or temporarily if she was injured? Who would manage the mother’s assets and protect them on behalf of her surviving daughter? The court would decide all of this and in the meantime, the child would be placed with protective services.
DO ONLY PARENTS NEED ESTATE PLANNING?
No, every person with assets and loved ones needs estate planning. If someone has assets and they have people, pets, or charities that they care about, they can be named in their estate planning documents. My clients are young, old, retired, working, single, married, people living together, parents, and not parents; they all choose to do estate planning because they want their assets, loved ones, and themselves, protected. A proper estate plan done by the right estate planning attorney makes all the difference as to how things are handled at the time of your death, disability, or disappearance.
