ESTATE PLANNING FOR PERMANENT RESIDENTS -SHOULD I BECOME A US CITIZEN?

This has been the question of the week! Let’s take two scenarios and see what works best. As always, these are examples used for informational purposes only. Please seek the advice of counsel for your specific needs. 

Scenario#1-Permanent resident married couple in late seventies, with less than five million in assets and three adult kids, all US citizens. Assets in US and France, both allow dual citizenship and have tax treaties with each other. Do they need to become citizens? Probably not. They benefit from the exemption amount same as citizens, thus they should be okay as permanent residents. 

Scenario#2- Permanent resident married young couple in their early forties, with many millions in assets, and three kids all US citizens. Assets in US and China. Do they need to become citizens? Yes, certainly yes! Why? Because they want the unlimited marital exemption, they want all the US citizen benefits, and they have no assets in China. Thus, why not become citizens and reap all the benefits?

ESTATE PLANNING-DO WE NEED ESTATE TAX PLANNING?

Getting back to our examples above, scenario one does not require estate tax planning at this time. Scenario #2 will benefit greatly from becoming US citizens and doing estate tax planning. This year, 2024, the individual death tax exemption is $13.61 million, double for a married couple, and unlimited for married citizens gifting money to each other.
