Five years ago, I helped my client with a Miami-Dade probate case for her grandmother’s assets to go to her father, the sole heir, per her grandmother’s will. Yes, even though her will stated her wishes, probate court was still required. A will does not protect you from needing to hire a Miami Beach probate attorney and go through the Miami probate process. The same client was back in my office this week with her father’s probate case. He refused to plan.

In the example above, we spoke about doing a revocable trust and funding it with Dad’s house, investments, bank accounts, and other assets. Speaking about it isn’t enough; thus, he died without an estate plan.
