Probate administration is the court process required when someone dies with assets in their own name. Probate is time consuming and very expensive. Probate comes with built in delays on loved ones collecting their money and assets.  Probate can be prevented with proper trust planning.

WHY IS FUNDING YOUR TRUST A MUST?

Funding your trust is a must! If a trust is not funded, or in simple language, if assets in a person’s name alone are left outside of the trust with no direct paid-on death beneficiary, probate court is required. Trusts and estate planning when done properly, can prevent Miami probate court from getting involved in your loved ones and assets.

DO I HAVE TO PUT MY REAL ESTATE IN TRUST?

Yes, real estate must be placed inside your trust. This is often done easily with a recorded quit claim deed. Your Florida trust can hold real estate in any other state by recording a quit claim deed in that state. 

HOW DO I HANDLE THE REAL PROPERTY? WHAT IF MY REAL PROPERTY IS NOT IN MY TRUST?

A client of mine recently passed away. Sadly, he has two real estate properties and stocks that were never transferred to trust.
