Powers of Attorney can be limited; allowing your nominee to move your assets into your trust only and offering you greater protection. Health care documents can explain what you want and do not want if you are not able to say so yourself. Wills describe your burial or cremation and name a guardian should you have minor children. Trusts describe who gets what and when; there is room for creativity in this document depending on the client’s vision and the laws at the time.

WHY WOULD YOU WANT TO BE PARTNERS WITH THE PROBATE COURT IN MIAMI-DADE OR BROWARD COUNTY?

The probate process takes a long time to be resolved even by the best of Miami Beach attorneys. Most of the documents become public records and real estate investors begin calling soon after the case is filed. Probate court controls your case entirely so even though the matter may be private, it is no longer a private matter. For example, I received a call today where a husband died after 44 years of marriage; they never had kids and she is entitled to the house they both lived in but why was there no will or trust? Why was the house in his name alone on the deed and not owned by a revocable trust?   

WHY DO A REVOCABLE TRUST? 

 Revocable trusts are so helpful for estate planning, death planning, disability planning, and protecting your loved ones. Revocable trusts can be as simple or as complicated as needed. I prefer to prepare wills and trusts rather than fight for a loved one’s rights in probate court. Even if there is only one beneficiary, for example, the spouse, everything must be official and proven in the probate court. Revocable trusts if created and funded properly, can avoid probate court entirely.

Estate planning is the process of creating, reviewing, signing, and most importantly, funding the trusts that we create. A trust left unfunded does not prevent probate court involvement. A will does not prevent probate court involvement. Another kind of trust is an irrevocable trust which is commonly used for tax planning, if needed. The estate tax exclusion amount for 2020 is $11,580,000 for a single person and double if the couple is legally married.
